Todd Boyer founded Boyer Wenter LLP after serving as Senior Shareholder at Littler Mendelson PC and Principal (Equity Partner) at Baker McKenzie LLP. For over 20 years, he has represented Fortune 500 companies in high-stakes employment litigation and advised C-suite executives on employment agreements, separations, and disputes.

Todd has spent more than three years embedded as counsel in technology companies, handling sensitive employment counseling matters ranging from executive-level internal investigations to crisis response. He has obtained dozens of workplace violence restraining orders on behalf of employers seeking to protect their employees from threats. He regularly advises companies on workplace violence prevention, threat assessment, and response protocols. His threat-response work has included obtaining protective orders for senior executives facing credible personal security threats.

Recent Representative Litigation Results

Todd has substantial trial and arbitration experience in complex employment matters. He was a primary member of the trial team in a $250 million wage and hour class action involving 17,000 class members, defeating seven of eight claims in a nine-week jury trial and all eight claims in the subsequent bench trial. He has obtained summary judgment in a multi-claim discrimination, retaliation, and leave interference case in federal court, which was affirmed on appeal by the Ninth Circuit. In arbitration, he recently secured a complete defense verdict against claims exceeding $2.7 million.

Todd has defeated class certification in numerous putative class actions involving meal and rest period violations, employee misclassification, and security screening time, and has successfully enforced arbitration agreements to dismiss class allegations. He led a global pay equity audit spanning 20 jurisdictions and has prosecuted trade secret theft actions against departing executives.

Executive Representation

Todd also represents senior executives in disputes with their employers. He recently represented the president of a technology company subsidiary in claims against the parent company for wrongful termination during protected medical leave, recovering the executive’s earned compensation and additional damages. His executive practice encompasses negotiating employment agreements, severance packages, and separation terms, as well as litigating breach of contract, discrimination, and retaliation claims when negotiations are unsuccessful.

Military Service

Todd is a retired U.S. Air Force Lieutenant Colonel with 20 years of combined active duty and reserve service in the Navy and Air Force. On active duty, he served as the primary legal counsel at Naval Air Station Fallon, home of the Navy's Top Gun fighter weapons school, advising commanders on federal tort claims, employment law, administrative law, aircraft accident investigations, and criminal matters.

In the Air Force Reserve, Todd served as Staff Judge Advocate for the 349th Air Mobility Wing at Travis Air Force Base, the largest associate reserve wing in the Air Force Reserve. He then became Deputy Staff Judge Advocate for 4th Air Force, where he provided legal advice to the commander responsible for over 16,000 Air Force Reserve personnel across 16 wings in the United States and Asia Pacific.

Subject Matter Expertise

Drawing on his military legal background, Todd has developed recognized expertise in the Uniformed Services Employment and Reemployment Rights Act (USERRA) and military leave issues under the FMLA. He is co-author of The Uniformed Services Employment and Reemployment Rights Act (BNA Books, 2009) and has written extensively on servicemember employment protections.
